About These Terms
By using the Keepin Cool Auto Air Conditioning website, requesting a quote, making a booking or authorising work on your vehicle, you agree to these Terms & Conditions.
These Terms apply to services, repairs, inspections, parts and other work provided by Keepin Cool Auto Air Conditioning (“Keepin Cool”, “we”, “us” or “our”).
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law (ACL).
Definitions
- Customer means the person or business requesting our services.
- Works means the air conditioning inspection, diagnosis, repair, servicing and other work performed by Keepin Cool.
- Parts means parts supplied and/or installed by Keepin Cool.
- Warranty means our voluntary warranty described below.
Authorisation for Works
By booking or authorising our services, you authorise Keepin Cool to:
- Inspect and diagnose your vehicle’s air conditioning system.
- Access, test and operate the vehicle as reasonably required.
- Recover, evacuate and recharge refrigerant where authorised.
- Remove, repair, replace and install air conditioning components.
- Carry out the agreed Works.
Any additional work or costs identified during the service will be discussed with you and require your approval before proceeding, where reasonably practicable.
Quotes and Estimates
Quotes are valid for 14 days, unless otherwise stated.
All prices include GST unless otherwise stated.
A quote is based on the information available at the time and may change if additional faults, damage or required repairs are identified.
We will seek your approval before carrying out additional chargeable work.
Payment
Payment is due upon completion of the Works unless otherwise agreed in writing.
Payment methods accepted include cash, EFTPOS, Visa and Mastercard.
Personal cheques are not accepted.
Where an invoice remains unpaid after the agreed payment date, we reserve the right to charge reasonable interest and recovery costs permitted by law.
Vehicle Responsibility
You must advise us of any known issues, damage, modifications or relevant information about the vehicle that may affect the Works.
You must notify us if the vehicle is unregistered before requesting any service that may require the vehicle to be driven on a public road.
Inspection and Diagnosis
Air conditioning systems can have multiple faults or pre-existing issues.
A diagnostic or inspection identifies faults based on the condition of the vehicle and system at the time of inspection.
Additional faults may become apparent once testing, dismantling or repairs are carried out.
Where additional repairs are required, we will discuss these with you before proceeding.
Warranty
Keepin Cool provides the following voluntary warranty for passenger vehicles:
12 months or 20,000 km, whichever occurs first.
The warranty covers defects in parts supplied and installed by Keepin Cool and defects in our workmanship.
All warranty claims are subject to inspection and assessment by Keepin Cool.
Where a supplied part is confirmed to be faulty and covered by our voluntary warranty, we will repair or replace the affected component as appropriate.
Warranty Exclusions
Our voluntary warranty does not cover:
- Refrigerant.
- Re-gassing.
- Refrigerant recovery and evacuation.
- Refrigerant and other consumables.
- Normal wear and tear.
- Accidental or external damage.
- Misuse, neglect or abuse.
- Damage caused by vehicle modifications.
- Faults or damage caused by third-party repairs or interference.
- Parts or components not supplied by Keepin Cool.
- Faults unrelated to the original Works.
Refrigerant and re-gassing are not included in our voluntary warranty.
If refrigerant is required during a warranty repair, the cost of refrigerant and re-gassing is not included in our voluntary warranty and may be payable by the customer.
Nothing in this section limits any rights the customer may have under the Australian Consumer Law.
Warranty Claims
Warranty claims must be reported to Keepin Cool as soon as reasonably possible after a fault is noticed.
The vehicle must be made available to Keepin Cool for inspection and assessment before warranty work is authorised.
Warranty Inspection and Diagnostic Fee
An applicable inspection and diagnostic fee may apply when a customer requests a warranty assessment.
The vehicle will be inspected to determine whether the reported fault relates to a part supplied and fitted by Keepin Cool or to our workmanship.
If the assessment confirms that a part supplied and fitted by Keepin Cool has failed and the fault is covered by our voluntary warranty, the inspection and diagnostic fee will not be charged.
If the fault is found to be unrelated to our supplied parts or workmanship, or is excluded from our voluntary warranty, the applicable inspection and diagnostic fee will apply.
Any additional repairs required outside the warranty will be discussed with the customer before work proceeds.
The customer must not authorise another repairer to carry out warranty repairs without prior approval from Keepin Cool.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
You are also entitled to choose a refund or replacement for major failures with goods.
Nothing in these Terms limits or excludes rights available under the Australian Consumer Law.
Manufacturer Warranties
Where a vehicle or component is covered by a separate manufacturer’s warranty, that warranty may have its own terms and conditions.
Customers should check the relevant manufacturer’s warranty requirements.
Limitation of Liability
To the extent permitted by law, Keepin Cool is not responsible for loss or damage caused by circumstances outside our reasonable control.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded under the Australian Consumer Law.
Third-Party Parts and Repairs
Keepin Cool is not responsible for faults caused by parts supplied by the customer or work previously performed by another repairer.
Where a third-party component contributes to an air conditioning fault, additional diagnosis or repair may be required.
Our voluntary warranty does not cover faults or damage caused by third-party repairs, modifications or interference.
Subcontracting
Where reasonably required, Keepin Cool may engage qualified contractors or third parties to assist with particular services.
General Conditions
- These Terms may be updated from time to time.
- The Terms applying at the time of booking or service will generally apply to that service.
- Any variation to agreed Works or pricing will be discussed with the customer.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
- These Terms are governed by the laws of Queensland, Australia.
